To legally send marketing faxes, businesses must have prior express invitation or permission from the recipient, or an Established Business Relationship (EBR). Even with an EBR, you are required to include a clear and easy-to-use opt-out notice on the first page of every fax advertisement. Failing to comply can lead to steep penalties—up to $500 per violation, or more if the court finds the violations were willful.

Additionally, it’s critical to maintain an internal Do-Not-Fax list, similar to a Do-Not-Call list in telemarketing. If a recipient requests to be removed, you must honor that request within a reasonable timeframe, typically 30 days, and ensure they are not faxed again. Each fax must clearly identify the sender with a business name, contact phone number, and a physical address. Many businesses overlook these simple but legally required disclosures, putting themselves at risk. International faxing brings additional layers of legal complexity, as each country has its own privacy and marketing laws. For instance, Canada’s CASL (Canada’s Anti-Spam Legislation) also governs electronic fax marketing and requires explicit consent.

To remain compliant and protect your business from legal issues, only use verified and opt-in fax lists from reputable providers who guarantee legal compliance. Avoid scraping fax numbers online or purchasing lists from questionable sources. It’s also wise to consult with a legal professional or compliance expert before launching your campaign. Compliance not only protects your company from lawsuits and fines—it also builds trust with your recipients, which increases the chances your messages will be read and acted on. In a niche space like fax marketing, reputation matters just as much as reach.
