Bitkom on the cabinet decisions on digital content, mandatory software updates and new information obligations
The Federal Government's Cabinet today approved several legislative proposals to implement the EU Digital Content Directive on the one hand and contractual provisions of the EU Modernization Directive on the other. The focus is on new obligations for online marketplaces as well as extended warranties and update obligations for software products and devices.




"We are concerned about the trend that companies are being asked to comply with uae gambling data more and more information obligations without any discernible added value for consumers. The new information obligations for operators of online marketplaces are partly impractical and questionable in their feasibility. As a result, they create a great deal of additional work for companies and consumers are confronted with more and more information sheets. One thing is lost sight of: digitization offers consumers an outstanding gain in sovereignty, and comparing offers and prices has never been easier than it is today. Transparency requirements must be about quality rather than quantity and, above all, about ensuring that consumers are informed in a meaningful and understandable way.

Increasing the security of devices through updates is a right goal. However, the cabinet draft that has been approved still leaves many questions unanswered. It remains completely unclear how long smart devices will have to be updated in the future . Consumer expectations must be balanced with product diversity and price stability. Lifelong update obligations, for example, would lead to significant price increases for products and applications. Ultimately, many cheap products would disappear from the market and the number of manufacturers would decrease. This could cause enormous harm to consumers."
